the fix for this issue is in the Atheros WLAN Driver 10.0.0.274
the link is from ASUS but the driver is generic to install on any Atheros WLAN chipset
ASUS and Acer have both using this version in their newly shipped laptops

That's the version I've been using for awhile, explains why mine has been working. Thanks for the info.
