Activated on wrong harddisk,can I stil activate on another

So here's the story,

I recently purchased a copy of Windows 8 through Upgrade Offer.

I upgraded my Windows 7 OS to 8.

I activated it fine.

But I realized I wanted to change the HDD - it was dying. And replacing my RAM set with another (bigger memory) as well.

So

1. can I take out my current harddisk that contains an activated Windows 8, install on new harddisk and activate it?

2. what kind of Windows 8 key do I have? OEM? Retail?

Might require phone activation. Should be able to do so.

I got my key through Windows 8 Upgrade Offer program. Key was sent to my mail, and I acquired the media install through the Upgrade Assistant program.

Actually I cannot use any program to migrate that way - old HDD is damaged. I don't want to risk the old harddisk. Just want to save the data / transfer the data I need (migration using your link would scan all harddisk part right?).

Why not back your data up to an external drive, including large flash drive? Then, do the migration. If your HDD is that bad off, then you really need to get your data off ASAP--without doing anything that will make getting data off later harder. See my sig; you could also create a system image backup and recover/restore it to a new drive using an external drive.

Yes. I have HDD dock.

I'll attach my old HDD to that HDD dock and connect with USB to retrieve the data. At least that's my plan.

Problem is the Windows like I described on #1.

Please clarify. I think I gave you one viable solution. There potentially are more, but, at this point, I need to know, for sure, what it is you want to accomplish.
