It's not checked when you by it. It is verified when you install it as it checks your PC to see if a qualifying version is installed.

lol That didn't answer my question. There is NO way of checking I have it "IN STORES" that is what I am saying....what you are saying is about a downloaded version.....obviously. Which I won't be doing.

Just like the link of how to do it said....you have to "download" it in order to get that price? lol They must be HIGH.

You can buy it in stores but not at the $39 price. There is not a check at the store and you can just buy it. But when you install it that is when it is checked.

If you prefer to shop at a local store, a packaged DVD version of the upgrade to Windows 8 Pro will be available for $69.99 during this promotion.

So we will all be penalised for following Microsoft's advice and doing a fresh install then!??!??!

Windows 8.1 Pro with Media Center

This is all a bit silly - Before Windows 8 - 99+% of PCs will have had OEM Windows installed - a very small number will be homebuilds, and even then, likely to have some OEM windows version installed. So every PC already has contributed to the MS treasury. Even if it has been running windows 7 with a loader ever since you wiped Vista off.

Another 40 - dollars, pounds, euros, whatever, and MS is getting money - for something they have just uploaded to some servers or mirror sites. Money for nothing. MS don't care about checking your eligibility - you're eligible - the fact you have a PC says so, and your $40 confirms it.

Mostly true, my bet is if you have a valid windows 7 key detected on your computer than you can download windows 8 pro for $40.

Media Center to me isn't very impressive, unless they have greatly redone it, which I don't think is the case.

Depends whether they mean "on your computer" or "already installed in the HDD/SDD or partition you are installing into...."

Meanwhile seems sensible to prepare a partition with a "clean Win 8 RP" install, then upgrade that one....????

Out of curiosity I decided to try an "upgrade" of a W8RP copy from my installation usb W8RP.
Booted and ran setup from the desktop as you do when upping W7.
You are not offered the option of - preserving programs - a true upgrade
    only preserve settings or none.
I conclude the RTM will be the same as is reported everywhere, therefore I will carefully reserve my W7 installation and upgrade that. Preserving settings is relatively trivial compared reinstalling gadgets, tools full bloodied programs etc finding installation discs some of which date back ten years.
Disappointing but no different from previous OS upgrades

I wonder if the installation keys will be region specific on installation, as happened with the office student editions some years back.
"this offer is not applicable to your region"
Otherwise change all settings - timezone, language, location etc. to pay $40 (26) instead of 40 and use a proxy

To do an upgrade, run the setup.exe on the USB from within the OS you're wanting to upgrade.

That's precisely what I did. Trying to upgrade W8RP to W8RP to see what options were available.
Sorry if I did not make it clear enough for you.
