Microsoft Sued for Misrepresenting Surface Storage Space

It looks like at least one Microsoft customer isn’t too happy with his new Surface tablet.

Andrew Sokolowski, a lawyer based in Los Angeles, filed a lawsuit against Microsoft on Tuesday for allegedly misleading consumers about the amount of storage space on the Surface tablet after he ran out of space on his 32 GB tablet shortly after buying it.

32GB = useless, less than half that = completely and totally useless.

They should be sued for putting out a useless product in an age where SSD's are smaller than 1/3 a deck of cards, there is no excuse for only putting 16GB or 32GB in a pad. Maybe they thought the cloud would save that mistake but I'd guess not.

I think it's kind of BS that you'd sue over something so menial. First off, EVERY PC maker that says they have a 500 or a 1,000 gig hard drive is obviously not telling the straight truth. In Windows, it's detected as 465 and 930 gigs respectively. Then, take away about 16 or so gigs for Windows itself. So in the end you have almost 50 gigs less than advertised. Just because a tablet has built in SSD storage of 32 gigs doesn't mean it will be a full 32 gigs. I've found myself that everything on it with Office and Windows, on a display model that has user data as well, it about 10.5 gigs. And this is actually on said Surface RT tablet with 32 gigs.

Now, there is a full sized USB port to connect terabytes of external storage to, as well as a microSD card that allows for an extended 64 gigs, which by the way in the amazon it's about 60 dollars versus paying 100 for an extra 32 gigs of built in storage, let alone s7 gigs of SkyDrive storage free. I don't know, I call BS....

He is a lawyer with a lack of thing to do. I would say an educated person would address the spec's and make a choice that they then become responsible for. We sue for greed, common sense no longer comes into the equation. I still love Windows 8, my Surface and my life - can I sue or be sued for any of that?:cry:

Yeah, but that's the difference between a MB being 1,048,576 and 1,00,000. That's the standard 7% that has been common forever.

Just because a tablet has built in SSD storage of 32 gigs doesn't mean it will be a full 32 gigs.
True, but a 16GB iPad has 14GB and my 32GB Asus had about 28GB. A 32GB surface has 10-15GB free. I think it's a bit unreasonable for people to expect their new tablet is more than 1/2 full already.

To be pedantic, I suppose that you mean trivial.

I should have sued Apple back in the fall of 1984 after I bought an original 128k toaster Mac. (22k of that was consumed by the display.) Steve Jobs swore that would be the baseline configuration, good for at least a few years' service. He lied. (I still did business with them until 1995.)

It's too bad that Apple has had such great success. Their overly locked-down hardware isn't a business model I like to see other companies adopt.

seems to me that MS is adopting a lot of the Apple model now. except they fail to provide stuff we wants.

No one is realizing that Windows RT along with Office 2013 Home and Student takes up, in actuality, roughly 10 gigs. Microsoft's Surface team manager claims that it takes up 12 or so gigs with Windows RT, OFFICE 2013 HOME AND STUDENT , and a "bunch" of apps. There is very little basis to sue if you understand that yes, the Surface RT has 32 gigs of storage for the base model, but it has Windows RT on it and OFFICE 2013 HOME AND STUDENT .

Of which, will only take 10 gigs without apps or user data. Actually, I might have to go recheck that because when I checked it with the Surface RT, this was including user data that the display models have on them to show things off. I don't believe that it actually takes up 16 gigs when Windows RT was built for smaller storage spaces and Office 2013 for RT was as well. It's a little preposterous to sue a company because they're advertising 32 and 64 gig tablets and you don't have the full space on them. This is been the norm for a LONG time now. The only difference I see is that you have less storage and therefore each gig counts, but even still, the lawyer in this case should had opened up Computer and checked the available space, and if he was running out of space he should had been a little more intelligent and got a 32 gig flash drive (which by the way isn't a true 32 gigs either) or an external hard drive (which also won't have true gig amounts either) or even a 16, 32, or 64 gig microSD card (which again, won't be true gig size as advertised). The Surface RT has a USB port to take advantage of, as well as a microSD card. If you have a Microsoft account, you have another 7 gigs to use in the cloud.

If I run out of space on my hard drive because I have 500 gigs of film and they don't all fit on my 465 gig hard drive, I'm not going to be a derp and sue Seagate for falsely advertising 500 gig hard drives when they're really not due to how the OS recognizes it versus how Seagate and other storage makers count byte and bit sizes. Are you actually going to sue SanDisk because a 32 gig flash drive isn't a true 32 gig size? NO!

I call this a case of user stupidity. There is little justification considering there are like more than three different options to compensate for storage.

This guy is a moron in my book. He apparently has zero understanding and did not bother to inform himself. It would have been easy to solve his problem with a couple of micro SD cards.

That reminds me the famous case where a guy sued a motor home company after he crashed with the motorhome. He had put the rig on cruise and went back to the bathroom. He claimed that should have been properly described (warned) in the user's manual.

10 gb for office, where did you get those numbers ?
I got these numbers from an ACTUAL Surface RT tablet. I went into the local drive, selected all three folders of Program Files, Users, and Windows, and hit Properties. It came up with about 10.2 gigs.

Even the Surface team's manager can back that up, along with having a lot of apps installed as well, being roughly 12 gigs.

i remember a guy sueing a drill company because he was drilling and got an itch on his nose, using the drill he scratched his nose and ended up drilling through his nose. his lawyer stated that no where in the drills manual does it state "not to be used to scratch your nose" and he won
