So does SurfCast have a shot at making this lawsuit stick? Well, over at Ars Technica, Jon Brodkin calls the company a "patent troll."
"SurfCast says it has suffered 'harm and injury' as a result of Microsoft's infringement," Brodkin writes. "But since SurfCast claims to have invented its tile-based technology in the 1990s and doesn't sell any products based upon it, it's hard to see how Microsoft's use of tiles in a brand-new operating system is costing the company any revenue."

It looks like the scrambled to get a quality website up just for this? It also describes their tiles as being used on phones, tablets and the cloud. Wow, I didn't know they had all that back in the 90's.

I guess they took after Apples actions. Samsung had been copying iPhone designs for years but Apple only sued them after Samsung became the top phone selling company.

Microsoft will just pay them, or license their patent(s). Happens a lot with technology. A company does something with a particular design, another company (let's call them trolls :) ) sue them over that. Then it gets settled.

I highly doubt the company lost any sales. it better be thrown out of court.

That might be a possibility considering since apple doesn't ever actually do anything innovative, they just purchase innovation and incorporate that into their product line. But considering apple's design philosophy is to use Photoshop to make everything fake looking and shiny and something you would be fine with giving your grandparents as it uses a UI model that was great in the early days of GUI computing; they'd never go for it. They would NEVER break their design that they feel is good as it is to do something cooler, better, and different that what is the norm.

Which was brought from Xerox, THEN became the macintosh operating system. It's already been known that Microsoft was developing a GUI based OS but apple beat them to the punch.

What Apple do is create markets.

Jobsy may only have had a couple of revelations - but that's enough.

Most people don't have a single one in their entire lifetimes.

I believe he said himself he got GUI the idea from Xerox , then MS got it from him.

What was special about him was that when he saw something - he knew how to grab it and work it into something consumers want.

I don't think he was the first to put internet connectivity on a phone - but he was the first to make it something the world lusted after.

That is a great and rare ability.

Uncle Tim is in the driving seat now. He is doing great so far. But it won't be easy to keep coming up with those sorts of revelations.

Bill and Steve both stole it from Xerox. Steve got the GUI out first, but back then, there was no real Licensing things or intellectual software Copywrites. That really was a Gates thing, if I recall.

Also, I don't care what product you have, Patents should not last forever. If you don't have something in the works and shopped around every so often and try to show improvements on your idea, I think you should lose any rights to claim it after a period of time, and since the 90's? Yeah, you lose.

From my understanding a Patent is there for a time period of development so noone can steal it and run with it for a period of time while you work out the kinks and details. If you have abandoned it. You lose.

Patent thing is a joke. The lawyers love it because they can make a bomb, and the truly big companies can wiggle out of even genuine ones (which I very much doubt THIS one is) but end up paying a fortune to lawyers.
Every time something "new" comes out theres a string of these kind of "firms" coming out from under their rocks and pushing their ridiculously vague "patents" as an excuse for sueing. Reading their claim, the word vague is an understatement.
