Doubtful that the hard drive is the problem, you could run a diagnostic by going to the hard disk manufacturers website and download their diagnostic utility to check the health of the drive if you wish.

More than likely there is some background processes that are operating when the computer is idle such as defragmenting, indexing etc., they usually settle down after a while. Maintenance in Action Center will give some idea what might be going on.

As a test turn off automatic maintenance and see if the CPU still spikes. If no change turn it back on.

Automatic Maintenance - Enable or Disable in Windows 8

It would also help to have your computer specs.

The spikes arent from the CPU, they're from the hard drive.. The cpu is working fine.

The computer is a toshiba laptop with an i7 2630-QM, 8GB RAM, GeForce GT540M and a 500GB seagate momentus xt

Windows defender is disabled ( i dont like it) and nothing is runnning. with everything closed the resources manager only shows the logs files being written to the disk. But that happens with every computer and this issue started last week i think. To skip a song in itunes it takes 5 seconds or more..
I used to have tonnes of programs opened at the same time and more than 5.5GB ram used and the disk worked fine without any spikes

Did you run the diagnostic tool from Seagate?

Momentus XT / Laptop SSHD | Seagate

    Also run chkdsk

Looks like your only recourse is to make sure that your bios is up to date and do a clean install. Back up your data first.

Solved Performance Lag Spikes, CPU Usage Decreases in Performance & Maintenance
It's an odd problem and I'm not really sure what is going on. Basically, it seems that from time to time the CPU usage of a certain program decreases for no apparent reason, when it should be actually getting higher, leading to performance lag spikes. I'll give an example to make the situation...
