Windows 8 upgrade not connecting to netgear dgn2200v3

Hi all, I have just placed windows 8 upgrade on a fresh partition on my Toshiba satellite c855-1gp
and its totally dead to the internet. when I switch over to windows 7 its totally fine.
I have tried both wired and wireless in windows 8 and its the same issue.
any ideas anyone??
