If it was an OEM version of Windows, it cannot be transferred.

Like Nuccii said, if its a factory OEM install, no you can't move it.

And the Retail version can usually be installed on a Replacement machine but has to be removed from the first.

Have seen various OEM versions not install on brands other than what it came with and sometimes only on certain models within that brand, OEMs are allowed to code the installation to prevent doing so.

What you can and can't do is detailed in the EULA, End User License Agreement. OEM versions have more restrictions on them than Retail versions.

I don't know what comes in the box, I haven't bought a retail copy of Windows in a long long time. I bought the OEM version of Windows 7 as it was cheaper than the Retail version. I now have an MSDN account and get my ISO files that way. I haven't burned a physical disk in ages either as I install from thumb drives.

Sorry to beat a dead horse, but...

Basically, there are 2 types of Windows licenses, Retail and OEM. It doesn't matter if it is a download, a single disk or in a box with full brochures and such.

Retail - This version can be moved between machines as long as you remove it from the old machine. You can't sell that old machine to someone else with that copy of Windows still installed and then still use it yourself.

OEM or System Builder - This version is cheaper than the Retail one. That's because even you aren't allowed to move it between systems. Once installed, it remains with that hardware (hence the OEM designation). You can upgrade components like hard drives, video cards, etc. but once you change motherboards and/or processors, you now have a different machine. Windows will detect it and have you reauthorize your copy.

Either version can be used for an upgrade path when another new version of the OS is released (i.e. moving between Vista and 7).

Can I transfer the software to another user?
You may transfer the software directly to another user, only with the licensed Computer.

Windows 8 System Builder Product--Personal Use License

Can I transfer the software to another computer or user?
You may transfer the software to another computer that belongs to you. You may also transfer the software (together with the license) to a computer owned by someone else if a) you are the first licensed user of the software and b) the new user agrees to the terms of this agreement. To make that transfer, you must transfer the original media, the certificate of authenticity, the product key and the proof of purchase directly to that other person, without retaining any copies of the software. You may use the backup copy we allow you to make or the media that the software came on to transfer the software. Anytime you transfer the software to a new computer, you must remove the software from the prior computer. You may not transfer the software to share licenses between computers. You may transfer Get Genuine Windows software, Pro Pack or Media Center Pack software only together with the licensed Computer.

At some point in the past the OEMs had to support the Operating System, not the publisher of it, haven't checked if that is still the 'deal' between Microsoft and the OEMs to make the OS less expensive on new machines. Just another one of those licensing things.
