    Hmm... I take back what I just wrote.

    I just read the Win 8 EULA and it does specifically say that it is a license to upgrade and that I forfeit the rights to the older software.

    I guess I'll delete the VM sooner than expected.

    Yes, the $40 was an upgrade.

    The list price for the Windows 8 Pro Upgrade is now $199. Microsoft Store - Buy Windows 8 Pro.

    You can clearly see in the picture it's "upgrade".

    It's gone, deleted, kaput. No more Win7 VM. I guess the DVD is pretty useless once you 'upgrade'. And it's so pretty.

    Seems like a strange way to do business, though.

    You could go back to Win7 and forfeit Win8. Although, technically I am not sure that is allowed.

    Well, this (Windows 8) is the first time MS has not offered a full "retail" copy of the OS. So, everything is an upgrade unless you buy the OEM/System Builder Copy.

    Also, in the past, OEM copies could not be moved (and still cannot if you buy a prebuilt computer). However, if you personally buy the System Builder copy for yourself, there is a clause to be able to move it now to a new computer.

    One more thing before we beat this topic to a pulp.

    The 'Certificate of Authenticity' for Win7 had instructions to peel it off and attach to the PC, which, of course, like any law-abiding citizen, I did.

    But the new certificate is glued to the Win 8 box and there is no instruction to attach. So my machine is still labelled Win7 even though that would be a wrong thing to run since I 'upgraded'.

    I wonder if I'm required by law to remove that old sticker and glue the Win 8 box to the side of my machine?

    You're right, glueing doesn't work, because the inner box just falls out when you display the certificate in the front.
    I guess that's why they cut out the window shapes in the outer box - you need to apply tape to the inner box as well.
