how to format old system HDD

Hello, I'm new here. I hope this is the right section to post this.

I have new Samsung Series 7 slate. It came with Windows 7 but because Windows 8 is much more touch friendly I upgraded to Windows 8.
In case that it will be problematic to install win8 for me or if there will be some major problem with drivers etc, I decided to install it as dual boot. There is only one small SSD hard drive in this tablet. I created another logical disk on it and install whole Windows 8 on this logical drive. Now because I solved all problems with drivers (like wacom pen pressure input and other) and already am really comfortable with Windows 8 I want to uninstall Windows 7.
And here comes the problem. I thought it will be no problem to format that part of disk with Windows 7 in it and than extend Windows 8 volume with this old win7 volume.. But I don't know why I wasn't able to format this win7 disk. So (unfortunately) I tried to just delete al files from this volume, but Windows 8 says that some of that files are in use by system and I cannot delete it .. It was stupid idea to just erase that data, I know.

    My questions are:
    1. Is it possible that there are some important files for windows 8 on old windows 7 volume?
    2. If it is safe, how can I format this old win7 volume? I was looking for some info here and I guess it will be possible from command prompt in boot repair mode (out of windows 8). But I don't want to try it without knowledge.

Please note I have tablet not PC so it might be a bit different in BIOS etc. Also I don't want to do clean install, because as I said I already solved quite a bit of driver issues etc and after clear install I will have to do the same again..

Thank you for any comments and help. This Windows forum and community looks like the best on internet.

You would need to post a screenshot of diskmgmt window.
