Hello nnvt, and welcome to Eight Forums.

One problem. If this is the same Windows 7 that you used to qualify to purchase the Windows 8 upgrade, then you are no longer legally supposed to use the Windows 7 product key while you have the Windows 8 installed.

This is part of the Windows 8 EULA below.

What about upgrading the software?
The software covered by this agreement is an upgrade to your existing operating system software, so the upgrade replaces the original software that you are upgrading. You do not retain any rights to the original software after you have upgraded and you may not continue to use it or transfer it in any way. This agreement governs your rights to use the upgrade software and replaces the agreement for the software from which you upgraded. After you complete your upgrade, additional software will be required to playback or record certain types of media, including DVDs.

You will have to have some sort of install medium? What do you have? Or plan to have?

It is possible to use qualifying software other than the Win7 installed on your machine in accomplishing what you want (i.e., you may have another piece of qualifying software whose use can be forgone after installing Win8). And, it is possible to install via a USB thumb drive (do you have an ISO?). See:

Windows 8 Upgrade Assistant - Download and Run (maybe pertinent to you in getting an ISO);

Clean Install - Windows 8 (general reference including link for creating an install thumb drive);

Clean Install with Windows 8 Upgrade (if need to use the refresh procedure to activate Win8); and

Dual Boot Installation - Windows 8 and Windows 7 or Vista (getting the dual boot done).

Thans for helping but i already fixed it by taking my dvd reader apart and cleaning it a bit!

and also the win 8 setup has an option to install on other partition why would it be illegal then since it's not an upgrade?

See my earlier post. You presumably will be using upgrade software (only other possibility having real pertinence would be to use system builder software/personal use license). If so, then, you are doing an upgrade regardless of the technical means used in doing the install. You need qualifying software to do so--basically you need an earlier version of Windows--where you forfeit your use rights upon performing the upgrade.

FYI: System builder software (not an upgrade) installed under personal use license. See this thread to understand what apparently is allowed under the personal use license: Win8 OEM System Builder License. For example, the "in-the-know view" is that one does not actually have to be building a PC to use this software/license. And, one can have one Win8 install on one owned computer at a time; Win8 can be reinstalled on this computer as many times as desired regardless of hardware changes made (quantity or scope); Win 8 can be installed on as many owned computers as desired one at a time; and Win8 can be transferred given that use rights are forfeited by the transferor.

Upgrade to Windows 8 - Microsoft Windows

Microsoft said:
Purchasing a full version of Windows 8

If you want to build your own PC and install Windows 8 or Windows 8 Pro, or want an additional operating system running in either a local virtual machine or separate partition (including a Mac), you can purchase the Windows 8 or Windows 8 Pro System Builder products (OEM versions). If available in your country or region, Windows 8 and Windows 8 Pro System Builder products can be purchased at participating stores, you'll need to ask a sales rep for more info. This version doesn't include customer support.
