    If you bought a machine that came with Windows 8, that key is in the BIOS. Use whatever media you can get your hands on. I would challenge Microsoft to prove which media you used to install the OS on the machine that you bought which came with a legal license.

    As long as you aren't going from say 8 standard to 8 pro, and you aren't using some type of activation hack mechanism to get your machine to activate then you are pretty much just fine as far as Microsoft is concerned. The EULA is a bunch of "legal-ese"

    If your install media uses the embedded key to install the same version it shipped with what's the big deal. If you were to go out and actually buy a new Retail DVD off of the shelf or online, its going to read and use the embedded code automatically, you don't get a choice. Microsoft did that on purpose, is that illegal, I don't think so.
