I currently have Win7 & Win8 preview in separate partitions on the same machine. I am trying to figure out the best way to install win8 pro on my system and keep my current dual boot setup with Win 7 intact and stay legal.

So....I have a 3 licence family pack of windows 7 of which I have used only 1 licence. Is there some way I can use one of the remaining win7 licences to upgrade win8pro over top of the Win8 preview and keep my current dual boot win7/win8 setup(legally) and without messing up my current Win7 installation (or Win 8 preview installation for that matter)? Is there any advantage in getting the OEM version instead?

If I understand it correctly; Anyone dual booting a legit version of Window Vista, XP or Win7 and Win8 RP can use the upgrade version of Win8 to do a clean install over the Win8 RP version.

You could upgrade the Windows 8 RP install.

Well OK then I guess I'll go ahead and take the plunge, there doesn't seem to be any reason to delay. Thanks for the reply

Just to help clarify. :)

Yes, you could upgrade from the "Windows 8 Release Preview" with the upgrade copy of Windows 8 since you can do a clean or ugrade install with the upgrade copy of Windows 8. You might as well do a clean install though since nothing from the "Windows 8 Release Preview" will be kept other than in the Windows.old folder.

However, you can only run the "Windows 8 Upgrade Assistant" from within the XP SP3, Vista, or Windows 7 that you are upgrading from to be able to purchase and download the Windows 8 ISO first.

Plus, you need to follow the EULA and not have the qualifying OS (XP SP3, Vista, or Windows 7) installed while the upgrade Windows 8 is installed. "Windows 8 Release Preview" is not a qualifying OS for the upgrade.

To comply with the EULA and be legal:

No qualifying OS to upgrade from = need to buy retail "system builder" copy of Windows 8

Want to keep both qualifying OS and Windows 8 installed = need to buy retail "system builder" copy of Windows 8

Want to replace your qualifying OS with Windows 8 = you can use "Windows 8 Upgrade Assistant" to purchase a upgrade copy of Windows 8

hmmm so if someone wants to keep win7 and win8 on same machine they "need" to buy retail system builder. How about if they have more than one Win 7 licence, can one be "used up" for the upgrade & the other one installed on the same machine?

Yes.

You can apply the upgrade to any XP SP3, Vista, or Windows 7 key you already own. :)
