My mouse stops working no matter what I do!

Hello

I just got this laptop literally yesterday. I'm already experiencing problems with it. But I don't want to start calling up the manufacture or anything just yet. Because I was doing a little bit of researching and it seems people have similar problems like mine but idk if it's exactly the same. Basically my computer will sound like its loading or something. And then the mouse won't work it won't move or anything. The programs behind it are acting fine but the mouse is just frozen. And it lasts for about 20-30 secs. And then it works again. But you can see that that can be a problem when gaming and doing important things. I checked and all the drivers are installed and up to date. I'm not sure what else to do some people said that toshiba or windows is supposed to be working on it. But that's a little ridiculous considering I just booted this up yesterday and everything seemed ok. I'd also like to mention that the touchpad is really slow as well. And I haven't done anything to my computer that would slow it down or whatever. I've checked the settings and my mouse is indeed on and not disabled by accident or anything. I have a toshiba satellite C55 laptop. And it's my first time with windows 8 but the side bar keeps getting in the way as well and Im wondering if thats also contributing to my mouse. I'm also using the touch pad not an external or USB mouse.
If anyone can clear this issue up for me I would eternally grateful!

That's OK, confused us a bit though. Make sure you have downloaded the latest drivers and BIOS from the Toshiba site. What model of touchpad, ALPS, Synaptics, Elan?
