Well, with the apple-Samsung trial over and done with, to me, it kind of sends a pretty resonating signal to phone makers using android: apple maybe breathing and shaking you down soon. I've read that the cost of patent royalties that would need to be paid to apple in order to properly license them would make a theoretically free to use OS to cost about 40 dollars, which I think might be closer to the cost of using Windows RT.

I know that Samsung for a fact will be using their GS III phone to port Windows Phone 8 onto as a device to sell. But, if apple continues their tirade against android, Windows Phone will be the only alternative that won't pile legal/patent licensing fees or have the issues that android is known for like SEVERE fragmentation, malware, and developer angst as people illegally sideload and pirate apps as well. Considering that Windows Phone 8 has a theoretical 64 processor core support, three screen resolutions, SD card support, and overall a better platform for developers as it is Windows core and it is regulated; that sounds to me like a good alternative to use. Even more so, WinRT tablets can be developed by the same companies and can be part of a new ecosystem that isn't apple.

Hopefully, the original epic battle will return to its roots as apple against Microsoft, Goliath and David, as it has been for almost three decades. We all know who wins in that battle... ;)

The trial may be over but the appeals process isn't. I wouldn't take any bets until the dust completely settles. MS has been suing Samsung in several countries, the only country Apple has prevailed in is the US.

The judgement was won against Samsung, not Google/Android so Samsung may need to raise their prices but others won't. That may change but we won't know that for awhile.

It's too soon to make decisions about which phone OS I'll be running in the future, in the meantime, I'm happy with Android.

    Retired in 2015 after working in the tech industry for 41 years. First 10 years as a Technician, the rest as a programmer/software engineer. After 1 year of retirement, I was bored so went back to work as a Robotic Process Automation Consultant. Retired for 3rd (and final) time in 2019.
If apple successfully takes down Google and Android disappears from the marketspace, what we would be left would would be an ecosystem almost exclusively owned by Apple and the iPhone. At present time, Windows phone can hardly even be considered a player in the marketspace.

And if a Windows phone does indeed because a player, what ensures that they aren't going to be embroiled in the same patent issues. Not all of them, for example, they certainly won't be accused of copying the home screen.

The patents here were

  • #381 ("bounce-back" when scrolling to the end of a list)
  • #915 (detection of pinch and zoom, versus scrolling)
  • #163 (double tab screen to zoom)
  • D'677 (looking like an iPhone physically on the front)
  • D'087 (looking like an iPhone physically on the back)
  • D'305 (home screen appearance)
  • D'889 (appearance of the iPad tablet physically)

At the end of the day, it's not like Android couldn't work without some of these features. However, it's obvious these are features that consumers want, the Iphone has and competition feels necessary to include on their devices. I guess the flip side would have been that without those features their phones would not have sold. So, will Windows phone have features so original and compelling that consumers will demand something different than what they demand today?????

I programmed pinch to zoom and two finger image rotation about 10 years go on touch screens. Double tap to zoom? How are those things patentable in the first place? My boss and I invented nearly every touch UI interface mechanism as far back as 20-25 years ago. But because we worked for a touch screen company, we didn't patent them, we made programs that demonstrated how to use them to the customers. Virtually all of those patents are bogus. An Apple loving, "America Fck Yeah" jury gave a foreign company the shaft, pure and simple.

And like you said, so many of these patents come after the fact that everybody is doing it, but nobody bothered to patent it. For example, the fact that MS has a patent on the use of the Page UP/Page Down key on keyboards....nevermind that key that existing and was labeled for years and years and years and apparently did absolutely nothing.

My boss and I invented nearly every touch UI interface mechanism as far back as 20-25 years ago. But because we worked for a touch screen company, we didn't patent them, we made programs that demonstrated how to use them to the customers. Virtually all of those patents are bogus. An Apple loving, "America Fck Yeah" jury gave a foreign company the shaft, pure and simple.

This is true. Out of ALL the patents apple has requested (patenting architectural design being one of many OUTRAGES), the pinch to zoom and double tap is just stupid. I mean come on.

Microsoft could definitely innovate their own gestures that aren't apple patents, they just need to apply themselves a bit more.

I agree with all this ill patent subject, the trial, judge, and the iMe jury. Don't forget the word "Metro". This is getting absolutely out of hand. Too many lawyers is what I think. I have a friend that's one and he agrees about all the bogus law suit trials in courts. What a racket!

Gotta go call him and ask to do a patent search on a square. I want to patent it. :D

MS are filing patents re human gestures.

Including a movement humans have been making for millions of years- separating the thumb and forefinger.

Apple can not attack android directly.

They are worried about it - so they look for other areas to attack - case design, gestures, icons, etc that Samsung have chosen.

The fact Apple are worried about android shows it is a major force and major player - in the phone market at least - and possibly soon in tablets, too.

That is a good thing.

The more os choices available , the better for the consumer.

It's good thing to have some OS choice, but not when it means a simple copy and paste of the most desired and sought out OS's out there. Yes, they definitely are worried about android as it is a potential threat, but android 2 isn't a threat to them, it's the later versions that are and seem to have a more, refined experienced that is STILL based off of ios. Honestly, I find android as a jailbroken ROM of ios...

And I doubt android is a threat to the ipad as it hasn't made an inch on apple so far. Unlike phones, people need phones to call and text primarily, but on a tablet people need something more and it seems the ipad is the something more, which is quite absurd since it's literally the ipod touch x 4 in screen size and even more absurd is a mini ipad that again, is the ipod touch x 2 in screen size, ALL powered by similar ARM Cortex processors. And to call an ipad an PC....POSH!!!

Now a Windows tablet PC is EVEN more than an ipad.

But back to android, it's claimed that Samsung and other makers wanted ios like design in their phones because that's what people were after and find desirable. So, emulate it without regard of legal issues. Now, I find that silly as ios has been the ONLY thing out there that people have more desire towards because THAT'S THE ONLY THING THAT THEY'VE BEEN EXPOSED TO. That's the biggie, even if you don't own an iphone but an android, you're basically using the same thing except shoddy built hardware, malware, more apps, and overall fragmentation. But the UI is very similar.

Enter Windows Phone. Research into user satisfaction of smartphones has found that Windows Phone and iphone both either tie for number 1 or 2 or one is just very slightly above the other in some instances regarding user satisfaction. android comes a rather distant third followed by Symbian or blackberry. That's pretty high for an OS that isn't slanderously ripped from apple and isn't even REMOTELY close to the UI of such. Even the users that have a Windows Phone overall love it and wouldn't go to any other platform, much like iphone users. Potential is there for Windows Phone 8 to really make into the mainstream. Probably the indirect goal of the "One OS to rule them all" is that once you use just ONE of the products, you'll be more attracted to the others. I've seen Xbox gamers go from the metro tile designed Dashboard of Xbox to Windows Phone and enjoy it. I've seen the same happen with Windows 8. They're already used to it, they like it, and other related products are great to them. And the best part that it can happen in whatever order or situation or whatever device. That is something that android has yet to offer, and is something apple is very slowly doing.

Remember, SAMSUNG got sued over their phone DESIGN and their custom Touchwhiz shell. This wasn't an ANDROID lawsuit or it would have been Apple VS Google. This is a rather easy fix for Samsung. Change the phone body and dump Touch"crap" for raw android interface. Most "true" geeks with android phones have already removed Touchwhiz, HTC Sense, MotoBlur, etc. Crap bloat shells is all those are.

Oh, and I tried win phone and sadly it's just not "there yet". Give it time to mature and I'll take another look.

I was at teched this year and tried it out on all the carriers and every model. Plus, sat in their class and listened to all their demos. I think that's a decent test enough for me.

And as far as bloat/crap ware. Yeah, phone manu's install it, some of it runs whether you want it or not eating battery and data.

No disrespect, but I don't want NFL, nascar, google+, sprint advertisements, korean keyboards, etc on my phone. Plus, as I mentioned already, their shells are "fat" and sluggish. Everyone wants a quad core phone only to have the manu's dump a slow a$$ interface on it when Google has already given a speedy one that can be used. That's what I "don't get". If they gave folks options to uninstall the carrier installed garbage, android users wouldn't complain, but the carriers "burn" it into the rom.

My verizon droid is littered with crap that I don't want on it. But Verizon doesn't provide me with a mechanism to get rid of it. So, I just deal with the fact that there are app screens full of stuff I will never touch. I simply modify the home screen to include just the stuff that I do use.

Crapware, bloatware on a PC seems bound to happen, but what I've never got is how that android users complain about bloatware on their phones. PHONES, for crying out loud. PHONES. :rolleyes:
My verizon droid is littered with crap that I don't want on it. But Verizon doesn't provide me with a mechanism to get rid of it. So, I just deal with the fact that there are app screens full of stuff I will never touch. I simply modify the home screen to include just the stuff that I do use.

Unfortunately a lot of that stuff is stuck in the main, and extremely limited, on-board memory and so even though it's hidden it is sitting there taking up tons of space. A lot of it auto-runs too so it's always in ram (also very limited) and using up CPU draining the battery faster.

Crapware on PCs can be eliminated. Crapware on phones is there forever (unless you root them, something most people cant or wont do). So it is actually many times worse on a phone. :(

Yeah, i don't root my phone. My phone is provided by my employer and they pay my cell phone bills. So, I just deal with the crap that is on the phone.
