BSODs from new laptop

I bought a new laptop (Windows 8, Dell Inspiron 15 3521 with the i5-3337u). I've turned it on maybe 20 times and experienced two BSODs, both shortly after reaching the login screen. I know BSODs are fairly common so mainly I would just like to know what kind of problem it is and whether it can be fixed, since I'd return it if it's a hardware problem (but such infrequent software issues I can deal with since I'm planning to use mostly Linux anyway). The error codes were BAD_POOL_CALLER and SYSTEM_THREAD_EXCEPTION_NOT_HANDLED_M. I did update the BIOS before the first crash occured, so that might be causing problems, although I'm hoping it's a bad driver. I have attached the output of the SF Diagnostic Tool.

Also, I have run 2 and 5 passes of memtest86+ with no detected errors.

Since there's only 2 memory dumps here, it's hard to pin this on something.
So, let's take a 2 pronged approach:
1st - please run Driver Verifier according to these instructions: Driver Verifier Settings
2nd - please run these free hardware diagnostics: Hardware Diagnostics (feel free to skip the MemTest86+ as you've already run it) If you have in-built Dell diagnostics please run them also (as they'll be required for warranty repairs).

Differing BSOD's are sometimes symptomatic of a low-level problem.
Since you don't appear to have any low-level 3rd party driver issues, then I'd have to suspect hardware problems.
But only having 2 memory dumps to work with makes this a very "iffy" conclusion - so we ask for Driver Verifier also, just in case it's a driver issue.

    Touchscreen on laptop/32" Toshiba on HDMI (laid the Sharp TV on a mouse and cracked the screen!)

    One Samsung 1tB drive - 5400 rpm. Gonna switch to a 7200/10000 rpm or an SSD (if I can find $500 for a 1tB SSD!)
    - Switched to 500 gB Samsung 840 series SSD - WOW!!!

Thanks a lot for your help! Since you think it could be a hardware problem I'm just going to return this to be safe since I still have the option. We could pin this down eventually but I don't want to waste your time when I could just get a new one. Thanks for the explanation! :)
