BSOD Watchdog Violation

I Upgraded from vista after trying the comusmer preview a few moths back(which worked flawlessly btw) and now after installed windows 8 I've come across this watchdog violation. I'm assuming its a driver error. I have an ati HD4870 and I know AMD will stop supporting these older graphics cards and that they released a legacy driver for windows 8. I installed it and it seemed to be running fine however the crashes started happening again so I don't know if it is the video card or something else.

I also have two ahrd drives, 1 320gb hitachi deskstar(windows installed) and a western digital blue 500gb(storage)
I tried running windows in safe mode and it still crashed, also when I tried the comusmer preview I installed it on a 20gb partition on the 500gb to try it and it worked fine without installing the legacy drivers, maybe it has something to do with the 320gb hard drive?

thanks for any information in advance.

I've been using blue screen view and it seems to point out that the issue is caused by an error with hal.dll and ntoskrnl.exe. I've only found solutions to fix theses errors with previous versions of windows and not windows 8. I even looked at the microsoft forum and all i found there was to to run a repair from the advanced start up menu. I tried the only repair option I found which was "automatic repair" but it didn't fix the problem. Is the repair they are referencing only available with the disc? That'll be a problem since I bought the 40$ download without the disk.

I did create a recovery drive and tried to repair the computer from the drive but still no luck.
I've updated every driver i could find that has a windows 8 version of the driver and it still seems to crash however it seems more infrequent than when it originally started.

If anyone can point me in the direction of a fix for hal.dll and ntoskrnl.exe errors for windows 8 it would be much appreciated. For now I will continue to look problems similar to mine and see if i can get any solutions.

Ok i just updated the driver, the issue is that the version of the driver is only compatible with previous versions of windows, so when I installed it, I ran it in compatibility mode with windows 7 64bit, will this be a problem? I'll respond back with updated dump files if I continue to receive crashes, thank you
