Windows 8.1 weird problems, anyone able to offer advice?

Okay so my laptop is a Toshiba Satellite C55D-A-13U, runs Windows 8.1 and has some serious issues.
It's a month old and has 8GB of RAM, AMD A6-5200 APU, Radeon HD Graphics and 1TB hard drive.
And also it barely works at all, which just doesn't make any sense.
My problem is that when I'm on the desktop my laptop will randomly freeze, I'll still be able to move the cursor around and if I press the windows home button, it switches between the start menu and the desktop but I still won't be able to click anything. And if I try, then eventually the cursor will freeze and I wont be able to do anything but wait for it to fix itself or suffocate it and just leave it off for a while.
I have anti virus software and it's protected properly but it just doesn't work, with 8gb of RAM there's no reason that it should slow down and freeze when I've just got Firefox or Chrome open.
I am going to bring it back to the shop to ask them what's going on, but if anyone has any idea or has heard of a similar issue would they please be willing to offer some advice?
I use my laptop for recreational use as well as college work, and although my laptop is 64bit, it can't handle the 64bit Photoshop CS6 without crashing?

There may be something running taking the processor time. Just for the heck of it, you might open the Task Manager and set it to watch the CPU usage to see if you notice any utility or process working during the delays.

You might also check the Event Viewer for any Error or Warning messages. There will usually be several so you will have to sort through them to see if anything might be relevant. Check the number of occurrences and when they happen.

Since it's only a month old the warranty should still be good. Why not take it back and have the place you purchased it fix it?

Did it come with 8.0 or 8.1 installed? Did you update from 8.0 to 8.1 though the Windows Store?
