Consider this closed for my issue. I restored using Macrium and then the system tried installing 8.1 again. It did successfully and the update process was in working order when it finished. Not sure what happen or how 8.0 saw 8.1 update, up until that point this was not an offered update.

I used Macrium to restore 8.0 and then let the machine sit over night. The restore was a total restore, all partitions that were on HDD were overwritten.
I restored the power option to sleep in 30 minutes. Maintenance set for 3:00 am.

@tsw88 did you get this issue fixed. I just updated to 8.1 and have the same problem. I can't install KB 3172614 mentioned by erpster.
Perform Sfc /scannow, no integrity violations found.
Spoke to soon. It will not do updates or Defender files. I ran trouble shooter, fix a problem and Defender Update ran successful. Updates just scan and scan. Member erpster suggested in another thread to install KB3172614. Downloaded and it just says searching for updates on this computer...
So for those that follow. No issues on this Pavilion 23. I used the iso burnt onto a DVD. Ran Setup from DVD. One hour later it is on the desktop. Haven't tried a reboot yet, just checking for updates. Product is activated. Thanks Brink for the support.
Came across an HP All In One running Windows 8. The store app has expired. I want to at least move this machine to Windows 8.1.
It has the license key in the BIOS.
I downloaded the ISO for 8.1 from Heidoc.
If I mount this ISO and run setup will it upgrade this device. I assume product key...
