in need of help with OEM win 8 istall and upgrade to win10

hi everyone!
i am runing a toshiba satelite using windows 7. the laptop originally came with windows 8, i couldnt bear the change so i switched back to 7 and today i want to get a legit copy of windows 10 -- that will last for over 1 year -- installed after reinstalling windows 8 (my win 7 isn't licensed). after running "ProduKey" i found a "windows BIOS OEM key" that apparently belongs to the OEM win 8.

can i install 8.1 with my win 8 OEM product key?
can i upgrade directly from windows 8 to 10 or do i need to update from 8 to 8.1 and from there upgrade to 10?
can i use the retail win 8 istallation files with an OEM product key or do i need the toshiba OEM installation files?

No need to install windows 8 - just install windows 8.1 via ISO and then upgrade to windows 10 via ISO
windows 10 just needs to see the activation of windows 7 or windows 8.1 to activate itself..

You will have to install the install type that was OEM on you computer., Core, Pro, single language. 32 bit or 64 bit Most likely it was installed UEFI , If you want your embedded key to auto activate.
