How to update a non-genuine W7 with a legit W8

I was the victim of a Windows 7 Ultimate forgery scam. I have a legitimate copy of Windows 8 Professional (upgrade pack) which I intend to install however, my question is, if the Win 7 installation is not legitimate, can I upgrade to Win 8 and retain my settings or do I need to reinstall Win XP (legit) and upgrade from that. Is it possible to upgrade W7 if I have a legit XP installed in the system on another HD?

If this is not possible, please advise as to the procedure to convert my Win 7 to Win 8.

Win 8 appears to generally work okay but I often receive the error message "programme is not responding". The programme needs to be closed via the window or the Task Manager. At other times the thing seems to just hang at other times while it's doing something then continues as normal.

Maybe I should see if I can buy a license for Win 7 although Microsoft do not seem interested. Maybe I should just either hack into Win 7 or investigate using Linux and W.I.N.E.

Any suggestions?

TBH I've never found upgrades to be that stable and would always go for the clean install.
