Folks, I upgraded three days ago with no problems.

1) MS asks your permission to install a FREE, no-obligation program that determines if you CAN upgrade to 8 Pro, and it even tells you which programs are incompatible.

2) I'm going to settle this question once and for all. I upgraded from the free Preview Edition, and I had not installed the Preview Edition on top of any other Windows OS. You CAN upgrade from your free Preview Edition, which keeps your current copy of Windows 7 legal.

3) It gets your credit card information.

4) It gives you a choice of how much of your stuff you want to keep.

5) After the one hour and fifteen minute download, it began a half hour installation process. It restarted several times, and I remembered that Windows 7 was my default start-up OS. But it changed the default OS to 8 without asking me.

6) The first thing you need to do with your new OS is find Windows Defender, which is activated but was 165 days old. I upgraded it immediately.

7) I have had no problems with it.

In addition to Theog's post above, the upgrade copy of Windows 8 allows you to do an upgrade or clean install with it. An upgrade copy of Windows 8 gets a price discount since you agree as per the EULA to either uninstall or replace (upgrade) the Windows that you are upgrading from with the upgrade copy of Windows 8. If you do not do this, then you will be in violation of the EULA and thus have an illegal installation. On a side note, please review the forum rules about illegal activity.

If you wish to keep and use both your Windows 7 and Windows 8 in say a dual boot or on separate computers, then you will need to buy a product key number for a retail system builder copy of Windows 8 instead.

Let me explain what they just said in simple English. You can buy a complete version of Windows 8 at a higher price, or you can pay $40 for the upgrade. If you upgrade your legal copy of Windows 7 to Windows 8 Pro, you can never use your Windows 7 copy again, anywhere, on any computer.

Therefor, I advise you to use the upgrade on your free Preview Edition of Windows 8.

The only problem with your advice is the preview edition of Windows 8 is not a qualifying OS for the upgrade to Windows 8 (RTM). That would be a violation of the EULA.

You can only legally run the "Windows 8 Upgrade Assistant" from within the XP SP3, Vista, or Windows 7 that you are upgrading from to purchase and download the Windows 8 ISO.

You will be able to install and activate your say Windows 7 (OS you upgraded from) again if you uninstall the upgrade copy of Windows 8 first. You can only have either or installed and activated when you go the upgrade route.

Just to help clarify. :)


Yes, you could upgrade from the "Windows 8 Release Preview" with the upgrade copy of Windows 8 since you can do a clean or ugrade install with the upgrade copy of Windows 8. You might as well do a clean install though since nothing from the "Windows 8 Release Preview" will be kept other than in the Windows.old folder.

However, you can only run the "Windows 8 Upgrade Assistant" from within the XP SP3, Vista, or Windows 7 that you are upgrading from to be able to purchase and download the Windows 8 ISO first.

Plus, you need to follow the EULA and not have the qualifying OS (XP SP3, Vista, or Windows 7) installed while the upgrade Windows 8 is installed. "Windows 8 Release Preview" is not a qualifying OS for the upgrade.


To comply with the EULA and be legal:

No qualifying OS to upgrade from = need to buy retail "system builder" copy of Windows 8

Want to keep both qualifying OS and Windows 8 installed = need to buy retail "system builder" copy of Windows 8

Want to replace your qualifying OS with Windows 8 = you can use "Windows 8 Upgrade Assistant" to purchase a upgrade copy of Windows 8

Okay, I'm trying to sift through the confusion here. Over the past few months, different people have contacted MS to ask if they can upgrade to 8 Pro from their free edition, and in every case, MS said that they could. Some of them even posted MS's replies. The Upgrade Assistant scans your OS to see if it is a legal copy of Windows and if it is compatible with what you want to do. It will tell you that the 64-bit 8 Pro cannot be installed on a 32-bit computer. If you have a 64-bit computer running a 32-bit XP, it will tell you that you need to buy the installation DVD. Depending on your version of Windows, the Upgrade Assistant offers you options about what you want to keep from your old system.

After scanning my computer, the Upgrade Assistant named four of my programs that were incompatible with 8 Pro, and then it gave me permission to proceed.

Yes, I agree that the inconsistant wording Microsoft uses doesn't help to make this clear at all.

What I posted above is the clarified version of the official way to comply with the EULA.

The main thing to remember is that you cannot legally have the qualifying OS (XP SP3, Vista, or Windows 7) installed while the upgrade copy of Windows 8 is installed.

Did you have any other questions that may be able to further help with understanding all of this?

To clarify, I'm guessing that you don't really mean "you cannot..."; rather, you mean "it's not legal to..." ?
