Solved Windows 8 upgrade to new hard drive

I have a Lenovo T400 with Vista Business 32b. The hard disk is only 160 GB and slow. I have a new 500 GB HD. I want to seize the occasion to upgrade both the HD and OS. I want to start fresh on a the new HD, I will move my data manually. What is the best route?

1) Upgrade the OS on the 160 GB HD. Create an image and restore the image to the new HD?
2) Try to transfer the Vista OS to the new HD and then upgrade?
3) Something else?

Kind of curious as well, my scenario is different. I have a home built computer, with Win 7.
1. Download Windows 8 upgrade from http://windowsupgradeoffer.com (Win 8 Pro)
2. I want to install on a new 128 SSD smaller and I can not ghost/Acronis because I can not go from 2.5 TB to 128GB
3. Can I install the new SSD insert USB/DVD with Win 8 Upgrade and go to install, on a new SSD. Will it prompt for a previous Key or maybe previous Win7 install media?

Depends whether you can intall Win8PRO Upgrade to a new disk. Somebody should know about now?

Otherwise I'd image old disk -> new disk (gives you a bu!) then upgrade that BUT during the upgrade select CUSTOM option to give you your clean install.

I have the same question: Old XP machine, new SSD for Win8...is this an upgrade or need OEM?

Any luck figuring it out?

I have now installed W8 CP on the new SSD, and booted from that disc...downloaded the Upgrade assistant, and it says to download W8 Pro for $40.

I think I may just go for it :p
Disconnecting my old HDD's in the process, to save my XP install just incase.

Will not activate, because the upgrade license is not valid a fresh install. No number to call for activation help like previous Win versions. I'm pretty upset about this, but hopefully I can get a hold of someone.

Actual error message "The Software Licensing Service determined that this specified product key can only be used for upgrading, not for clean installations."

Hope this helps, and you haven't wasted your time on this same route yet! Will follow up if I can get an answer.

Here is the rout that I took:
Reinstalled Vista Business 32b on fresh HD. I had to reactivate Vista by phone. I then installed Win8 without any trouble.

I was expected to have the choice of 32b or 64b. I was given no choice, Win8 32b was installed. I have 4G of memory in the laptop and it support 64 as I run Win7 54b on it

Indeed if you install an upgrade on a blank partition, there is no reason why the installer would think it's an upgrade over an existing OS.
