Mobo give startup code 40 when booting?

Every time i turn my PC on, it will show post code 40 and my stable 4.6ghz OC will be at stock speeds like nothing took in the BIOS. I've ran countless programs to verify my OC so i'm fairly certain its not the cause. If i reboot my machine, everything comes out fine and ill have a post code of AA which is what i want.

it would be nice to turn on my machine in the morning without having to reboot it after it gets to the desktop. Could this be a windows problem or hardware issue?

If that code 40 is a BIOS error message, then I do not believe its a Windows issue. If the motherboard won't post the OS isn't loaded so its not a factor. Your overclock may have been stable but if you have overstressed your hardware it can become unstable. Back it off a bit and see if the error goes away. Filling in your system specs will help immensely. Not knowing what motherboard you have hinders things.

My motherboard has a display for 2 digit codes and 40 is ACPI/ASL Checkpoints and means the system is waking up from an S4 sleep state.

I do not know if this is the same as your setup, since I do not know what your setup is.. If that is correct, I think S4 is hibernation. Could you try not letting it hibernate?

Thanks guys i did a little research and its a Windows 8 sleep state action that happens during a cold boot. It can be fixed by disabling this option.

My specs are as follows:

ASUS Rampage IV extreme
i7 3930k @4.6 at 1.36v
32 gb Dominator platinum 2000mhz at 1600mhz.
2x Samsung 840 pro 256 SSD's in Raid 0
1x Crucial 128 gb SSD
4TB external WD mybook


Power options>system settings>uncheck "turn on fast start up (recommended)" under shut down settings.
