Hello there,

I have a pretty simple question. Let's say someone is using a non-legit copy of Windows 7... would he still be able to get the windows 8 upgrade at the discount price from the MS website?

Thanks

Microsoft said:
What about upgrading the software? The software covered by this agreement is an upgrade to your existing operating system software, so the upgrade replaces the original software that you are upgrading. You do not retain any rights to the original software after you have upgraded and you may not continue to use it or transfer it in any way. This agreement governs your rights to use the upgrade software and replaces the agreement for the software from which you upgraded. After you complete your upgrade, additional software will be required to playback or record certain types of media, including DVDs.

NO as, You would have NO original software.

The cheap ($40US) upgrade download is, as far as I know, only available through running the Upgrade Assistant from a PC with a qualifying previous Windows OS (XP, Vista, 7). The Upgrade Assistant will only give a version of 8 at the same bit depth as the downloading machine (32 or 64 bit); you can't get the 64 bit download using a 32 bit machine.

However, the downloaded upgrade copy can be installed on a different machine than the one use to buy it.

Whether this approach could be used to violate the license agreement and install an upgrade copy on a PC that lacks a qualifying OS (which would include one with an illegitimate copy), I have no idea.

The full version of Win8 Pro lists for $140US. It is not, as far as I know, available for download yet. It can be legally installed on any PC. Unlike the old System Builder license, it can be transferred among machines by the original owner.

Short answer: yes. You could choose either the 32 or 64 bit version.

You should have made a new post, though, rather than hanging the question on the end of this thread.
