Sitting here reading a couple of threads, and thought ok lets follow the link to the Windows 8 upgrade advisor and see what happens.
Ran the advisor, picked up that 8 of my apps need updates, not a problem but the rest are ok. no hardware issues except can't use Win8 secure boot as bios doesn't support UEFI, not bothered about that.

The followed the rest of the upgrade advisor. I run Win 7 Ultimate X64 with 3 x 27" monitors so the advisor came up with win8 pro, then asked me if i wanted to keep all settings, just my personal files or nothing so thought ok lets try each one and see what the advisor says every time the advisor came back with Win8 pro at £24.99.

So thought ok just been paid only £24.99 the bluerays from HMV can wait till next week, so pressed the buy now button.

Currently downloading with 35% completed estimated time remaining 28min 43 seconds

am i going mad or will it be a case of seeing the light.

It saw you had Windows 7 installed and during the upgrade process it will give you those 3 choices. If it was Vista or XP it will not give you the Keep all Settings choice. When you do your upgrade it will look to see what is installed and give you the proper choices.
